By use of the 98over.com website you irrevocably submit to the exclusive personal jurisdiction of United States Federal Court for the District of North Carolina over any action, suit or proceeding arising out of our relating to this agreement or the transactions contemplated by this agreement, unless said Court does not have subject matter jurisdiction, in which case the parties irrevocably submit to the exclusive jurisdiction of District Court for the County of Transylvania, State of North Carolina over any such action, suit or proceeding.
